1. Jurisdiction & Governing Law
These Terms are governed by and construed in accordance with the laws of the Independent State of Papua New Guinea. Any legal dispute, claim, or proceeding arising under or in connection with WokHap shall be submitted to the exclusive jurisdiction of the National Court of Papua New Guinea at Waigani / Port Moresby.
Users accessing WokHap from outside Papua New Guinea remain responsible for full compliance with local laws and PNG cyber regulations.
2. Strict Anti-Scam & Zero-Fee Mandate
In accordance with the Employment Act 1978 (PNG) and fair trading principles:
No legitimate employer or authorized recruitment agent in Papua New Guinea will ever ask a jobseeker to pay money for application processing, interview slots, medical forms, uniform bonds, or employment guarantees.
- Any employer listing that solicits mobile payments (e.g. mobile banking, top-ups) or unverified wire transfers will be removed immediately and referred to law enforcement under the Cybercrime Code Act 2016.
- Users agree to report suspicious listings immediately via the platform reporting tools.
3. Applicant Code of Conduct & Authenticity
When registering and using WokHap, jobseekers commit to:
- Truthful Qualifications: Accurate representation of educational history (Grade 10, Grade 12, Diplomas, Degrees from UPNG, PNGUoT, DWU, etc.) and professional licences (CPA PNG, IEPNG, NATTB, Medical Board).
- No Identity Theft or Forgery: Uploading fraudulent certificates, altered transcripts, or impersonating other individuals constitutes criminal forgery and identity fraud under the Cybercrime Code Act 2016 (Part II).
- Legitimate Applications: Applying exclusively for bona fide employment opportunities in good faith.
4. Employer Obligations & Verification
Organizations advertising positions on WokHap must represent bona fide legal entities operating lawfully within Papua New Guinea:
- Companies must be registered with the Investment Promotion Authority (IPA) or be legitimate statutory bodies, government departments, church agencies, or certified NGOs.
- Job listings must clearly outline legitimate job duties, genuine closing dates, official application channels, and conform to the Employment Act 1978 regarding fair employment conditions.
- WokHap reserves the right to suspend or reject any listing that fails legitimacy checks.
5. WokHap AI Career Engine Advisory Disclaimer
WokHap provides automated AI match fit scoring, readiness gap analysis, and cover pitch drafting powered by artificial intelligence:
- Advisory Guidance Only: AI match percentages, readiness evaluations, and pitch suggestions are automated algorithmic estimates intended to guide candidates. They do not constitute a guarantee of shortlisting, interview invitation, or employment.
- Independent Employer Decisions: All recruitment, shortlisting, and hiring decisions remain solely within the discretion of prospective employers.
- Candidate Verification: Candidates are responsible for reviewing and confirming the accuracy of any AI-generated pitch before transmitting it to employers.
6. Limitation of Liability
To the maximum extent permitted by Papua New Guinea law:
- WokHap functions as an employment information directory and career matching tool. We are not an employer, labor broker, or employment agency unless expressly stated in a formal partnership contract.
- WokHap is not liable for agreements, employment contracts, dispute resolutions, or workplace interactions entered into between job applicants and independent employers.
- We make reasonable efforts to verify employer legitimacy, but encourage candidates to exercise due diligence when attending physical interviews in PNG.
7. Termination & Account Deletion
You may terminate your agreement with WokHap at any time by deleting your account. WokHap reserves the right to suspend or permanently ban any account found in violation of these Terms or engaged in cybercrime activities under PNG law.
